Business Immigration programs

Business Class immigrants are selected on the bases of their ability to create jobs for themselves and other Canadians. Some business programs are managed through Provincial Nominee streams, but others are managed directly by the Ministry of Immigration, Refugee and Citizenship Canada.

All provincial business programs operate on an Expression of Interest (EOI) basis, where all EOIs are ranked and placed from the highest to the lowest score. The EOI is not an application, but merely a preliminary screening process to identify the candidates that meet the requirements of a provincial program.

A candidate usually needs to provide a business plan and agree to a performance agreement. Upon completion of the performance agreement, the candidate’s application is filed and approved. After completing this step, the candidate applies to the federal government for final approval.

LMIA

Labour Market Impact Assessment (LMIA) – an economic assessment conducted by the Government to make sure that the Canadian companies by hiring foreign nationals do not ignore, prevent or disfranchise able Canadians from finding an  employment.

“Work” is defined in section 2 of the IRPR as “ an activity for which wages are paid or commission is earned, or that is in direct competition with the activities of Canadian citizens or permanent residents in the Canadian labour market. Hence, the Government of Canada is assessing the work activities for the foreigners.

There are two types of LMIAs. One for the foreigners who want to work as Temporary Foreign Workers. It costs $1,000.00CAD (government fee) + immigration consultant fee. The second type of LMIA is for the foreigners who are applying for permanent residency and need it to buttress their applications. For the second type the government does not charge $1,000.00CAD.

It is useful to think of LMIA as a “quality control” process. Only positive and neutral LMIAs lead to the work permits for foreigners. There are also some exemptions.

If you are thinking of hiring foreign nationals, contact Arcadia Immigration Consulting Inc for more information.

-- Ministerial Instructions Part 1: Vol 151 (2017) define "invest" as means to buy shares or other forms of equity in a business.
Business immigration programs are designed for the purpose of engaging in the business activity in Canada, rather than for the purpose of acquiring a status or privilidge under the law. It does not mean that the business needs to be successful.

Start-up Visa Program

Applicants in the Start-Up Visa program have to build a new business in Canada and obtain support from:

  • one or more designated Canadian Venture Capital Fund; or
  • two or more designated Angel Investor Groups; or
  • accepted into one program of a designated business incubator.

The new business needs to obtain a minimum investment of $200,000 from one or more Canadian Venture Capital Funds or a minimum investment of $75,000.00CAD from two or more angel investors. The applicant does not need to invest his/her own money.

The Government of Canada issues work permits to the applicants while they are waiting for their main applications to be processed.

A minimum language requirement is IELST 5.

On your behalf Arcadia can help you prepare a market research and business plan, as well as, reach out to venture capital funds, angel investors or designated business incubators. Contact Arcadia today to guide you through this process and make your dream come to reality.
