what You Need to Know?
Who can be sponsored?
Sec. 117 of the Immigration and Refugee Protection Regulations (IRPR) describes who can be sponsored:
- Spouse, common-law partner, conjugal partner;
- Dependent Children (under 22 years);
- Brothers, sisters, nephews, nieces, grandchildren who are under 18 and are orphaned;
- Adopted children;
- Parents, grandparents and their dependent children (under 22 years);
- Any relative if the sponsor in Canada is alone and without any other family.
All sponsorship applications are assessed based on the sponsor’s financial assets (with some exceptions) and on his/her ability to sponsor a family relative. The relative, in turn, needs to show a genuine relationship between the sponsor and him/herself.
There are different financial requirements when it comes to sponsoring either a spouse with or without dependents; sponsor’s children; other relatives or parents/grandparents.
There are 2 streams for sponsorship:
- Members of the Family in Canada Class and is governed by ss. 123-129 of IRPR;
- Members of the Family “Outside Canada” Class is governed by ss. 116-122 of IRPR.

Family "Outside-Canada" Class
The Foreign Nationals who are being sponsored as members of the Family Class (i.e. “Outside Canada” Class) are not assessed on their ability to become economically viable and independent as the economic immigrants are, but on the basis of their familial relationship to the sponsor who is a Canadian citizen or Permanent Resident.
The Government of Canada places onus of establishing the nature of the relationship to the sponsor on the applicant. The connection/relationship must be genuine and not for the purposes of gaining immigration status in Canada.
The Applicant needs to prove that the relationship is genuine and not entered for the purposes of gaining immigration status. The applicant also needs to declare all accompanying and not accompanying relatives, because otherwise they will be excluded from being sponsored (or invited to Canada) in the future.
The Sponsor, on the other hand, must prove that he/she meets requirements of s. 13(1) of the IRPA and s. 130-133 of the IRPR, that is, whether the sponsor is able to sponsor the applicant(s).
An Immigration Officer will examine the sponsor’s part in Canada, whereas a Visa officer in the applicant’s country of residence will examine the applicant’s part.
If both the sponsor and applicant currently live in Canada, the applicant still can apply under the “Outside Canada” stream (Family Class), but he might be called outside Canada for interview. This option, however, will give allow them to appeal to the Immigration Appeal Division.
Under the Family Class/Outside Canada stream, the right of Appeal to IAD exists, but only to challenge the factual conclusion of the immigration/visa officer.

Family "in-Canada" Class
In-Canada Class – is open to the spouses with or without dependents and to the parents/grandparents who are already in Canada. Even if they are illegally in Canada, they still can be processed as “Members of the Family in-Canada Class” if documents are properly filed. The In-Canada Class is processed out the Immigrtion Office in Mississauga, Ontario.
Who May be a Sponsor?
- Canadian citizen or PR;
- 18 years+;
- Reside in Canada;
- PR must reside in Canada at the time of submitting the sponsorship application; Citizens can live overseas at the time of submitting the documents, but must return to Canada at the commencement of the sponsorship.
- Not have been sponsored to Canada as a spouse within the past 5 years (also s. 13 od IRPA);
- 5 year ban on former sponsored persons;
- Must be PR for 5 years before submitting a sponsorhip application.
Ineligible Sponsors
- Subject to removal order;
- In penitentiary, jail, prison, etc;
- Previously convicted of a specified (e.g. sexual, violent) offence;
- Sponsor is banned for 5 years from sponsorship;
- If convicted overseas, the sponsor must show acquittal or rehabilitation.
- In default of spousal payments, or debt payments, etc;
- Undischarged Bankruptcy;
- Sponsor in receipt of social assistance;
- In default of previous sponsorship undertaking.
