Temporary Resident VIsa (TRV) – commonly known as a “visitor visa” is a document that grants a person the privilege to enter Canada as a visitor, entrepreneur or as another member of the visitor-class. TRVs are not to be confused with study or work permits. Canadian Common Law tradition (Obeng v Canada, 2008 FC 754, [2008] FCJ No 957.) assumes that all visitors who are entering Canada are potential immigrants. It is up to the visitors to prove otherwise, but if you work with us, Arcadia does it for you.
Study permit – a document that lets students to attend a school, college or university and remain in Canada for the duration of an entire educational program, if it is longer than 6 months. When a Canadian Embassy approves the initial study permit, it also automatically issues a temporary resident visa (TRV) to enter Canada.
Work permit – could be restricted or open. It is a written authorization that allows a foreign national to engage in work. The work permit can be extended. If your initial or previous work permit expired and you need new work permit to continue working in Canada, Arcadia can file the application on your behalf. Restricted Work Permit – issued as part of Temporary Foreign Worker Program (TFWP). This permit requires the LMIA to be submitted on behalf of the employer who is looking to hire a foreign worker. In turn, the worker needs to submit a separate application for the temporary foreign work permit overseas. Once issued, the permit will be restricted to that specific employer. Open Work Permit – is a work permit that is not job-specific and does not need the LMIA or proof that an employer has submitted an offer of employment.

Study or Work without a Permit
Most foreign nationals wishing to study in Canada require a study permit, which is a legal document authorizing a foreign national to engage in studies with a Canadian educational institution. However, in certain unique circumstances, a foreign student may study without the study permit. Contact us to find out if you ca study in Canada without the permit.
Canada also allows certain occupations to work without a work permit. Below are the most common occupations that do not need a work permit:
- a full-time student, on the campus of the university or college;
- a performing artist appearing alone or in a group in an artistic performance, acting in a time-limited engagement;
- an athlete, participating in sports activities or events, either as an individual participant or as a member of a foreign-based team or Canadian amateur team;
- an employee of a foreign news company for the purpose of reporting on events in Canada;
- a judge, referee or similar official at an international amateur sports competition, an international cultural or artistic event or competition or an animal or agricultural competition;
- a guest speaker for the sole purpose of making a speech, short seminar;
- a priest or spiritual leader – responsible for assisting a congregation in the achievement of its spiritual goals and whose main duties are to preach doctrine, perform functions related to gatherings of the congregation or group or provide spiritual counselling.

Work while studying
If a student works for 20 hours per week on a campus, but still cannot afford groceries and expensive rent in Toronto or elsewhere in Canada, then, the student may qualify for an open work permit that is concurrent with his/her study permit.
Sec. 199 of the Immigration and Refugee Protection Regulations (IRPR) allows the student, – albeit with some conditions, – to apply for the concurrent work permit.

Flag-poling for Study or work Permits
Arcadia drives its clients for an extra fee to the Canada-US border to extend their study/work permits in a practice known as “Flag-poling.”
We are complying with the rules of Canada Border Services Agency (CBSA). They implemented a procedure for extending study/work) permit applications made by the individuals who currently reside in Canada and possess valid study/work permits, and were brought by their representative to the Canada-US border for the sole purpose of presenting their permit applications for extension at a Canadian port of entry.

PR Travel Document (PRTD)
You can apply for the PRTD if you lost or do not have a valid PR card, while you are outside of Canada but plan to return to Canada by airplane, boat, train or bus.
This document can be issued outside Canada or at a port of entry (POE), depending on a situation. If you lost your PR card while travelling overseas, the PRTD is a convenient permit that will let you to return to Canada without any problems.
TRV Refusals
TRV Refusals – sec. 10 of the Immigration and Refugee Protection Act (IRPA) states that all visitors to Canada need to apply for their initial TRVs overseas, that is, at the Canadian Embassies in foreign countries. If your visitor visa was refused by a Canadian Embassy and you are unhappy with its decision, then call Arcadia today. We can help you reverse and overturn that decision by re-arguing the TRV application from the perspective of administrative law, by applying legal standards used by the Canadian federal judges in their judicial reviews and by probative examination of facts and specific clauses from the IRPA.
Study Permits
Temporary Resident Permit (TRP) – also known as “Minister’s permit” and may be granted in accordance with sec. 24 of the Immigration and Refuge Protection Act (IRPA) in exceptional circumstances to a person whose visa is denied. A TRP permit may be issued outside Canada at a Canadian Embassy or Consulate General to the individuals who are otherwise are inadmissible..
Super Visa for Parents and Grandparents
Super visa for parents and grandparents– a visa that lets your parents and grandchildren stay in Canada for up to 2 years at a time. It’s a multi-entry visa that provides multiple entries for a period up to 10 years.
The invitees (parents or grandparents) need to be insured with a Canadian company for at least 1 year from the date of their entry to Canada and for the amount of at least $100,000 coverage. The inviter needs to proof his/her income is equal or above the latest minimum income (LICO) requirements.

Once in Canada, a visitor may extend his/her TRV visa from inside Canada. The visa can be extended as many times as necessary, as long as there is still a valid reason for the visitor to enter/remain in Canada. The students on the study permits in Canada and the workers on the work permits in Canada can easily extend their TRVs as long as their permits and passports are valid and have not yet expired.

Extend Study Permits
If your original or previous study permit expired and you need new permit to continue studying in Canada, then, Arcadia can advise you on collecting the right documents with correct information, and file the application on your behalf. Arcadia guides its clients through the whole process of extending the study permit.
Restore & Prolong Study Permit
If you have not applied to extend your study permit and lost your status in Canada, you cannot study until the IRCC restores your status and extends the study permit. You have 90 days to restore and extend the status and permit.
Restoration of the status cannot be granted at the port of entry. Individuals who have failed to comply with the conditions imposed under section 185 of the Immigration and Refugee Protection Regulations (IRPR), need to apply in Canada for the restoration of their status. If they leave Canada, they will be deemed to be seeking a new entry on their return.
Post-graduate Work Permit
This is an open work permit for recent graduate students. The permit is Labour Market Impact Assessment (LMIA) exempt and is issued for 8 months or 3 years, depending on a student’s length of study program.
If a PGWP application is filed improperly, then, a student is running the risk of getting the PGWP for 8 months, when he/she should really qualify for the PGWP for 3 years. Retain Arcadia today to make sure that you get the right representation and your PGWP application is approved.

Temporary Foreign Worker and LMIA-based Work Permit
A temporary foreign worker can apply for an LMIA-based work permit before entering Canada (IRPR, s. 197); upon entering Canada (IRPR, s. 198); or apply for the permit after entering Canada (IRPR, s. 199).

Open Work Permit
You qualify for it when you are one of the following:
- Student who’s no longer able to meet the costs of your studies (destitute student);
- Worker who has problems with an employer-specific work permit and are being abused or at risk of being abused in relation to your job in Canada;
- Applicant in waiting for permanent residence in Canada;
- Dependent family member of someone who applied for permanent residence;
- Spouse or common-law partner of a skilled worker or international student;
- Spouse or common-law partner of an applicant of the Atlantic Immigration Pilot Program;
- Spouses of foreign workers whose work fall under NOC skills type 0 or skill level A or B;
- Refugee, refugee claimant, protected person or their family member;
- Former refugee under an unenforceable removal order, who cannot be removed for security reasons, etc.;
- TRP holder;
- Young worker participating in special programs;
- In-Canada permanent resident applicants and their family members who are members of the following classes, determined eligible for permanent resident (PR) status: live-in-caregiver, interim pathway for caregivers, spouse or common-law partner, protected persons, and humanitarian and compassionate considerations (H&C);
- Persons whose work permits were authorized by a migration office abroad, where the permit was not issued at a port of entry;

Bridging Open Work Permit (BOWP)
Bridging Open Work Permit (BOWP) – is a special permit that lets you keep working while waiting for the results of your permanent residence application. If you applied for the permanent residence under one of these programs, then you qualify for the BOWP:
- Express Entry;
- Provincial Nominee Program (PNP);
- Home Child-Care Provider Pilot or Home Support Worker Pilot;
- Caring for children class or caring for people with high medical needs class;
- Agri-Food Pilot.
All these programs have one common condition of eligibility for the BOWP. The applicant must be in Canada on a valid work permit that expires in 4 months or less.
Work Permit under International and Mobility Program (IMP)
The IMP permit is a permit does not require LMIA, but the work permit still needs to be issued based on employer’s applications to IRCC and its “A-file number.” It could be an open or restricted work permit that is built on 2 columns of the IMP: 1) Intranational agreements and 2) Canadian Interests.
Canada is a signatory to such agreements as Canada-US-Mexico Agreement (CUSMA) and Canada-European Union Comprehensive Economic and Trade Agreement (CETA)
Canada-US-Mexic0 Agreement:
- Professionals (in 60+ pre-approved occupations);
- Intra-company transferees (ICT):
- Executive/Senior Level Manager and Specialized Knowledge employees;
- Business visitors (no work permit required).
Canada-European Union Comprehensive Economic and Trade Agreement (CETA):
- Key Personal:
- Intra-company Transferees (Senior Personnel, Specialists, Graduate trainees);
- Investors;
- Business visitors for investment purposes;
- Contractual Service Supplier and independent Professionals:
- Contractual Service Supplier;
- Independent Professional;
- Sort Term Business Visitors.
It is in the interests of Canada to grant work permits to the individuals who pose significant benefit to Canada. The significant experience is considered as 10 years of experience, with various accolades, recognitions, publications, etc. The following individuals are sought after by Canada:
- Entrepreneurs:
- Self-employed Program: must demonstrate that starting a business in Canada would be a significant benefit to the country;
- Racing jockeys;
- Outfitters (fishing/hunting) camp owners/operators;
- Intra-Company Transferees:
- Executive/managerial and specialised knowledge positions;
- Opened to any executive from any country;
- Emergency Repair Personnel:
- Emergency repair (of regular) personnel – to prevent halt in manufacturing;
- Work permits are issued up to 30 days;
- Reciprocal Work Permit Category: Formal programs like International Experience Canada;
- Religious or Charitable Work Permit: Religious workers require work permits even if their positions are unpaid, but volunteers at religious events do not need work permits.
*CETA allows spouses of CETA Intra-Corporate Transferees are eligible for Open Work Permit for the same duration as main applicants. Such provision does not exist in CUSMA.

The type of work permit you get in the International Co-op (Internship) category is an employer-specific work permit. The internship you are offered in Canada must be directly linked to your field of studies.
